AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Interested parties note that the Texas Private Security Board (PSB) currently has statutory authority to enter into reciprocity agreements with other jurisdictions and to issue licenses under the Private Security Act to individuals with credentials from other states under reciprocity agreements.
H.B. 2135 amends the Occupations Code to require PSB to adopt rules, as soon as practicable after the bill's effective date, under which PSB may waive any prerequisite to obtaining a license for, and credit experience for a license requirement to, an individual who PSB determines has acceptable experience gained during service in a branch of the United States military, including the United States Coast Guard.
H.B. 2135 amends current law relating to waivers and grants of credit for the requirements to obtain certain private security licenses to individuals who hold security credentials from the United States armed forces.
RULEMAKING AUTHORITY
Rulemaking authority is expressly granted to the Texas Private Security Board in SECTION 2 (Section 1702.1183, Occupations Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends the heading to Section 1702.1183, Occupations Code, to read as follows:
Sec. 1702.1183. RECIPROCAL LICENSE FOR CERTAIN APPLICANTS.
SECTION 2. Amends Section 1702.1183, Occupations Code, by adding Subsection (c), to require the Texas Private Security Board (PSB) to adopt rules under which PSB is authorized to waive any prerequisite to obtaining a license for, and credit experience for a license requirement to, an individual who the board determines has acceptable experience gained during service in a branch of the United States armed forces, including the United States Coast Guard.
SECTION 3. Requires PSB to adopt rules to implement Section 1702.1183(c), Occupations Code, as added by this Act, as soon as practicable after the effective date of this Act.
SECTION 4. Effective date: September 1, 2013.
