BACKGROUND AND PURPOSE

 

Interested parties have requested that measures be taken to ensure that consumers understand the transaction into which they are entering when purchasing a manufactured home and to assist consumers who may have reservations about a seller in independently verifying the seller's information. C.S.H.B. 2210 seeks to address these issues by requiring the posting of certain information outside of a manufactured home offered for sale, exchange, or lease-purchase.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 2210 amends the Occupations Code to prohibit a person from selling, exchanging, or lease-purchasing or negotiating for the sale, exchange, or lease-purchase of a used manufactured home unless the person, in a manner specified by the bill, posts on the door of the home for the duration of the period the home is offered for sale, exchange, or lease-purchase, as applicable, a copy of the statement of ownership and location for the home and information held by the Texas Department of Housing and Community Affairs of the existence of any tax liens on the home.

September 1, 2013.

While C.S.H.B. 2210 may differ from the original in minor or nonsubstantive ways, the following comparison is organized and highlighted in a manner that indicates the substantial differences between the introduced and committee substitute versions of the bill.

SECTION 1. Subchapter C, Chapter 1201, Occupations Code, is amended by adding Section 1201.119 to read as follows:

Sec. 1201.119. PUBLIC INFORMATION ON LICENSE HOLDERS. The department shall make publicly available on its website information regarding persons licensed under this subchapter including:

(1) the current status of a license and the date a license or renewal license was issued, suspended, revoked, or denied;

(2) a license holder's business contact information, including telephone number, mailing and physical address, and website, if any;

(3) the business contact information for any affiliate of the license holder; and

(4) the nature, status, and resolution of any complaint filed against a license holder.

No equivalent provision.

 

SECTION 2. Subchapter J, Chapter 1201, Occupations Code, is amended.
