BACKGROUND AND PURPOSE

 

According to interested parties, the law permitting certain people to file documents electronically for recording with a county clerk in certain counties has become restrictive, despite its intent to facilitate interaction with people with whom counties expect to work frequently.

 

H.B. 2436 seeks to match the law to its intent by allowing counties with a population of 500,000 or more to authorize certain persons to file documents electronically for recording with a county clerk.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2436 amends the Local Government Code to authorize a county with a population of 500,000 or more to authorize a person to file electronic documents or other documents electronically for recording with a county clerk, in addition to the persons authorized to file electronically under statute, if the county enters into a memorandum of understanding with the person for that purpose.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
