BACKGROUND AND PURPOSE

The Cibolo Creek Municipal Authority provides regional wastewater services for the area northeast of San Antonio, including Schertz, Cibolo, Selma, Randolph Air Force Base, and portions of Live Oak, San Antonio, and Universal City. Interested parties note that the authority has provided services both within its boundaries and in areas outside of its boundaries through long-term contracts with several cities, and these parties contend that adjustments to the authority's boundaries should be made based on these services. C.S.H.B. 2617 seeks to provide residents served by the authority with the opportunity to vote in authority elections and to have representation on the board of directors by adjusting the boundaries of the Cibolo Creek Municipal Authority.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

C.S.H.B. 2617 amends Section 4, Chapter 347, Acts of the 62nd Legislature, Regular Session, 1971, to change the boundaries of the Cibolo Creek Municipal Authority.

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.

SECTION 2.  (a)  The legal notice of the intention to introduce this Act, setting forth the general substance of this Act, has been published as provided by law, and the notice and a copy of this Act have been furnished to all persons, agencies, officials, or entities to which they are required to be furnished under Section 59, Article XVI, Texas Constitution, and Chapter 313, Government Code. (b)  The governor has submitted the notice and Act to the Texas Commission on Environmental Quality. (c) The Texas Commission on Environmental Quality has filed its recommendations relating to this Act with the governor, lieutenant governor, and speaker of the house of representatives within the required time. (d)  All requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished. SECTION 3.  This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2013.
