BACKGROUND AND PURPOSE

 

Medicaid fraud is becoming more and more prevalent. Interested parties assert that the state will continue to waste resources and the administration of the Medicaid program will become more inefficient if certain revisions to the law are not made. H.B. 2869 seeks to address Medicaid fraud committed specifically by a provider of durable medical equipment.  

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that rulemaking authority is expressly granted to the executive commissioner of the Health and Human Services Commission in SECTION 1 of this bill.

 

ANALYSIS

 

H.B. 2869 amends the Human Resources Code to require the executive commissioner of the Health and Human Services Commission to adopt rules requiring that a provider of durable medical equipment and supplies under the Medicaid program cancel and stop delivery of an order for durable medical equipment or supplies on the request of the intended recipient of the equipment or supplies under the Medicaid program.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
