BACKGROUND AND PURPOSE

 

While chiropractors are approved providers for physical examinations required under rules of the Federal Motor Carrier Safety Administration for all commercial motor vehicle licenses, which is the standard used by the Texas Department of Public Safety, interested parties note that current law regarding this issue is unclear and that certain school districts in Texas do not recognize the validity of such a physical examination performed by a chiropractor for a school bus driver. H.B. 3183 seeks to clarify Texas law to conform to current federal regulations.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3183 amends the Transportation Code to include a chiropractor among the medical professionals authorized to conduct an examination approved by the Department of Public Safety to determine a person's mental and physical capabilities to operate a school bus safely.

 

EFFECTIVE DATE

 

September 1, 2013.
