BACKGROUND AND PURPOSE

 

Interested parties report that the use of video for certain Texas Alcoholic Beverage Commission training is prevalent across the state, especially in remote regions of Texas that do not always have Internet connectivity and that are not easily accessible by licensed instructors.  The parties further contend that, with recent changes that may make video-based presentations a noncompliant training format, the absence of video training materials will place undue hardship on thousands of participants and employers and will burden them with inconvenient and costly alternatives. H.B. 3306 seeks to ensure the ongoing availability and affordability of certain video-based alcohol seller training.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3306 amends the Alcoholic Beverage Code to prohibit the Texas Alcoholic Beverage Commission from denying the approval of a seller training program on the ground that the program presents the information using only an audiovisual recording.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
