BACKGROUND AND PURPOSE

 

Current Texas law authorizes in-state residents who are on active duty and stationed outside of the state or country to be exempt from state motor vehicle safety inspection requirements. This exemption, however, does not currently extend to the annual renewal of a motor vehicle registration. H.B. 3379 seeks to address this issue. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3379 amends the Transportation Code to exempt from annual vehicle registration requirements a renewal of registration by a person who is a Texas resident, is on active duty in the U.S. military, and is stationed in or assigned to another state or nation under military orders on the date the person's registration renewal becomes due. The bill makes statutory provisions regulating the abatement and removal of a junked vehicle or vehicle part or statutory provisions prescribing an administrative adjudication process for the enforcement of an ordinance relating to abandoned vehicles inapplicable to a vehicle or vehicle part that is stored or parked in a lawful manner on private property and that is temporarily exempt from registration renewal requirements for certain military personnel under the bill's provisions.

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
