AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3660 amends current law relating to requiring the Texas Commission on Fire Protection to conduct a study and prepare a report on administrative attachment.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter A, Chapter 419, Government Code, by adding Section 419.013, as follows:

 

Sec. 419.013.  STUDY ON ADMINISTRATIVE ATTACHMENT; REPORT.  (a)  Defines “state agency” in this section.

 

(b)  Requires the Texas Commission on Fire Protection (TCFP) to conduct a study on the administrative attachment of TCFP to another state agency in order to reduce the costs associated with TCFP, improve the provision of TCFP services, and lower the fees set and collected by TCFP under this chapter.

 

(c)  Authorizes TCFP to request the assistance of any state agency if TCFP needs assistance to conduct the study required under this section.  Requires the agency to provide the requested assistance.

 

(d)  Requires TCFP, not later than September 1, 2014, to report the results of the study to the legislature, the governor, and the Legislative Budget Board.  Requires that the report submitted include a complete explanation of the process used by TCFP in conducting the study required under this section and:

 

(1)  if TCFP finds that administrative attachment to another state agency would further the goals listed in Subsection (b) identify a single state agency to which TCFP is required to be administratively attached, selected using the criteria prescribed by Subsection (b), and include drafts of proposed legislation necessary to accomplish the administrative attachment; or

 

(2)  if TCFP finds that administrative attachment to another state agency would not further the goals listed in Subsection (b):

 

(A)  identify, for each goal listed in Subsection (b), at least five reasons why administrative attachment would not further that goal;

 

(B)  describe in detail TCFP's plan for meeting each goal listed in Subsection (b); and

 

(C)  include drafts of proposed legislation necessary to accomplish TCFP's plan under Paragraph (B).

 

(e)  Provides that this section expires September 1, 2017.

 

SECTION 2.  Effective date:  upon passage or September 1, 2013.
