AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Lieutenant Stuart Alexander, a 20-year veteran of the Corpus Christi Police Department, was killed on State Highway 358 in the line of duty on March 11, 2009.  He is survived by his wife, his son, and three grandchildren. H.B. 3831 seeks to honor fallen Corpus Christi police officer Lt. Stuart Alexander and other peace officers who have sacrificed their lives in service to their communities.

 

H.B. 3831 amends the Transportation Code to designate the portion of State Highway 358 from Interstate Highway 37 to State Highway 286 in Nueces County as the Peace Officers Memorial Highway, in addition to any other designation.

 

The bill requires the Texas Department of Transportation, subject to a grant or donation of funds, to design and construct markers indicating the designation as the Peace Officers Memorial Highway and any other appropriate information and to erect a marker at each end of the highway and at appropriate intermediate sites along the highway.

 

H.B. 3831 amends current law relating to the designation of a portion of State Highway 358 as the Peace Officers Memorial Highway.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter B, Chapter 225, Transportation Code, by adding Section 225.092, as follows:

 

Sec. 225.092.  PEACE OFFICERS MEMORIAL HIGHWAY.  (a) Designates the portion of State Highway 358 from Interstate Highway 37 to State Highway 286 in Nueces County as the Peace Officers Memorial Highway. Provides that the designation is in addition to any other designation.

 

(b)  Requires the Texas Department of Transportation (TxDOT), subject to Section 225.021(c) (relating to providing that TxDOT is not required to design, construct, or erect certain markers unless a grant or donation of funds is made to TxDOT to cover the cost of the design, construction, and erection of the marker), to:

 

(1)  design and construct markers indicating the designation as the Peace Officers Memorial Highway and any other appropriate information; and

 

(2)  erect a marker at each end of the highway and at appropriate intermediate sites along the highway.

 

SECTION 2. Effective date: September 1, 2013.
