BACKGROUND AND PURPOSE

Interested parties note that when the Fort Bend Subsidence District was created more than two decades ago, it provided for certain local representation on its board of directors, but the district has not adjusted that representation to reflect the changing demographics of the county. The parties contend that a large percentage of the county's population now resides in unincorporated areas, particularly the northern area constituting the North Fort Bend Water Authority.  H.B. 3866 seeks to address this issue by providing for representation for the residents of this area.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 3866 amends the Special District Local Laws Code to increase from 13 to 15 the number of directors on the board of directors of the Fort Bend Subsidence District and to require the board of directors of the North Fort Bend Water Authority, as soon as practicable after the bill's effective date, to appoint the two additional directors. The bill provides for the staggered terms of all 15 directors. The bill establishes that the Fort Bend Subsidence District retains all the rights, powers, privileges, authority, duties, and functions that it had before the bill's effective date.

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
