AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3877 amends the Special District Local Laws Code to establish provisions relating to the Ellis County Municipal Utility District No. 1 and requires the district to comply with all applicable requirements of any resolution adopted by the governing body of a municipality that consented to the creation of the district or to the inclusion of land in the district. The bill grants the district the power to undertake certain road projects and provides for municipal annexation and a strategic partnership agreement. The bill authorizes the district, subject to certain requirements, to issue obligations for road projects and impose property taxes. The bill authorizes the division of the district into two or more districts under certain circumstances and sets out provisions relating to the division of the district. The bill establishes that any new district created by division of the district is subject to voter approval at confirmation election and municipal consent.

 

H.B. 3877 amends current law relating to the powers and duties of the Ellis County Municipal Utility District No. 1, grants a limited power of eminent domain, provides authority to issue bonds, and provides authority to impose taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8467, as follows:

 

CHAPTER 8467.  ELLIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 1

 

Sets forth standard language for the creation of the Ellis County Municipal Utility District No. 1 (district) in Ellis County.  Sets forth standards, procedures, requirements, and criteria for:

 

General provisions (Sections 8467.001-8467.005);

 

Powers and duties of the district (Sections 8467.051-8467.055);

 

General financial provisions of the district authority to impose a tax to repay bonds (Section 8467.101); and

 

Bonds and authority to issue bonds and other obligations (Sections 8467.151).

 

Grants limited power of eminent domain.

 

SECTION 2.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 3.  Effective date: upon passage or September 1, 2013.
