BACKGROUND AND PURPOSE

 

Interested parties note that the Tarrant Regional Water District, a water control and improvement district, has been governed by a five-member board of directors since its creation several decades ago.  The parties further note that while district directors have historically been elected to four-year terms at elections in May of each even-numbered year, based on certain statutory authority the district board of directors recently moved its directors' election to odd-numbered years.  H.B. 3900 seeks to update the district's governing legislation regarding these topics.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3900 amends Chapter 268, Acts of the 55th Legislature, Regular Session, 1957, to require the Tarrant Regional Water District to be governed by a board of five elected directors.  The bill establishes that the directors serve staggered four-year terms and until their successors have qualified. The bill requires the appropriate number of directors to be elected on the uniform election date in May of each odd-numbered year.

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
