AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The East Montgomery County Municipal Utility Districts Nos. 5, 6, and 7 were created several years ago with initial defined boundaries. Interested parties note, however, that due to changes in the development plan for the land encompassed by the districts, it is necessary to adjust the boundaries of the East Montgomery County Municipal Utility Districts Nos. 6 and 7 to better serve the development.

 

H.B. 3910 amends current law relating to the boundaries of the East Montgomery County Municipal Utility Districts Nos. 6 and 7.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 2, Chapter 775, Acts of the 79th Legislature, Regular Session, 2005, as follows:

 

Sec. 2 (a) Creates this subsection from existing text. Provides that the East Montgomery County Municipal Utility District No. 5 initially includes the territory in the certain areas described herein. Makes nonsubstantive changes.

 

(b) Sets forth new boundaries of the East Montgomery County Municipal Utility District No. 6. Deletes existing text setting forth the boundaries of the district.

 

(c) Sets forth new boundaries of the East Montgomery County Municipal Utility District No. 7. Deletes existing text setting forth the boundaries of the district.

 

SECTION 2. Provides that the East Montgomery County Municipal Utility Districts Nos. 6 and 7 retain all rights, powers, privileges, authority, duties, and functions that they had before the effective date of this Act.  Authorizes the East Montgomery County Municipal Utility Districts Nos. 6 and 7, notwithstanding any other law, to continue to rely on any bond election held before the effective date of this Act.

 

SECTION 3. (a)  Provides that the legislature validates and confirms all governmental acts and proceedings, including an election, of the East Montgomery County Municipal Utility Districts Nos. 6 and 7 that were taken before the effective date of this Act.

 

(b)  Provides that this section does not apply to:

 

(1)  an act, proceeding, director, other official, bond, or other obligation the validity of which or of whom is the subject of litigation that is pending on the effective date of this Act; or

 

(2)  an act or proceeding that, under a statute of this state or the United States, was a misdemeanor or felony at the time the act or proceeding occurred.

 

SECTION 4. Provides that the amendments made by this Act to Section 2, Chapter 775, Acts of the 79th Legislature, Regular Session, 2005, do not alter or otherwise affect the boundaries of the district territory of the East Montgomery County Municipal Utility District No. 5.

 

SECTION 5. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 6. Effective date: September 1, 2013.
