BACKGROUND AND PURPOSE

 

The East Montgomery County Municipal Utility Districts Nos. 5, 6, and 7 were created several years ago with initial defined boundaries. Interested parties note, however, that due to changes in the development plan for the land encompassed by the districts, it is necessary to adjust the boundaries of the East Montgomery County Municipal Utility Districts Nos. 6 and 7 to better serve the development. H.B. 3910 seeks to address this issue.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3910 amends Section 2, Chapter 775, Acts of the 79th Legislature, Regular Session, 2005, to revise the boundaries of the East Montgomery County Municipal Utility Districts Nos. 6 and 7.  The bill establishes that the districts retain all rights, powers, privileges, authority, duties, and functions that they had before the bill's effective date and that the districts may continue to rely on any bond election held before such date. The bill provides for the validation and confirmation of certain district actions and proceedings taken before the bill's effective date.
