BACKGROUND AND PURPOSE

As part of the Parks and Wildlife Department (TPWD) sunset bill, TPWD and the Texas Youth Commission, which is now the Texas Juvenile Justice Department (TJJD), were directed to seek a modification of the Parrie Haynes Trust to make TPWD the trustee. Interested parties note that TPWD has already terminated its lease of the Parrie Haynes Ranch and has informed the office of the attorney general and TJJD that TPWD does not wish to seek to transfer control of the Parrie Haynes Ranch and the Parrie Haynes Trust. S.B. 157 seeks to amend current law relating to the Parrie Haynes Trust to remove the requirement that trust modifications be pursued.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

S.B. 157 repeals Section 17, Chapter 952 (H.B. 3391), Acts of the 81st Legislature, Regular Session, 2009, relating to the requirement for the Parks and Wildlife Department (TPWD) and the Texas Juvenile Justice Department to jointly seek representation by the attorney general to pursue a modification of the terms and purposes of the Parrie Haynes Trust so that, among other purposes, TPWD may be designated as the state agency responsible for the trust.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
