AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the position of the district attorney who serves both Parmer County and Bailey County is designated as a part-time position. Because of the increasing workload of this position, the district attorney now functions at a full-time level. In 2011, the district attorney disposed of 104 cases in Bailey County and 94 in Parmer County and had four jury trials.
This bill adds the 287th Judicial District prosecutor to the list of professional prosecutors under Section 46.002 (Prosecutors Subject to Chapter), Government Code.
As proposed, S.B. 268 amends current law relating to the application of the professional prosecutors law to the district attorney for the 287th Judicial District.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 46.002, Government Code, to add the district attorney of the 287th Judicial District to the list of district attorneys who are subject to Chapter 46 (Professional Prosecutors).
SECTION 2. Effective date: September 1, 2013.
