AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The purpose of S.B. 283 is to more easily facilitate consensus among the commissioners of the Texas Historical Commission by reducing the number of commissioners from 17 to nine.

 

As proposed, S.B. 283 amends current law relating to the number of members of the Texas Historical Commission.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Sections 442.002(b) and (c), Government Code, as follows:

 

(b) Decreases the number of members of the Texas Historical Commission (THC) from 17 to nine.

 

(c) Provides that members serve for staggered six-year terms, with the terms of one-third of the members, rather than the terms of approximately one-third of the members, expiring February 1 of each odd-numbered year. 

 

SECTION 2.  (a) Provides that of the five positions on the THC that have terms scheduled to expire on February 1, 2015, two of the positions are abolished on September 1, 2013.

 

(b) Provides that of the six positions on the THC that have terms scheduled to expire on February 1, 2017, three of the positions are abolished on September 1, 2013.

 

(c) Provides that of the six positions on the THC that have terms scheduled to expire on February 1, 2019, three of the positions are abolished on September 1, 2013.

 

(d) Requires the governor to designate on or before September 1, 2013, which members' positions shall be abolished on September 1, 2013, and to inform the presiding officer of the THC which positions are abolished.

 

SECTION 3.  Effective date: upon passage or September 1, 2013.
