AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The purpose of C.S.S.B. 283 is to more easily facilitate consensus among the commissioners of the Texas Historical Commission by reducing the number of commissioners from 17 to nine.

 

C.S.S.B. 283 amends current law relating to the number of members of the Texas Historical Commission.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Sections 442.002(b) and (c), Government Code, as follows:

 

(b) Decreases the number of members of the Texas Historical Commission (THC) from 17 to nine.

 

(c) Provides that members serve for staggered six-year terms, with the terms of one-third of the members, rather than the terms of approximately one-third of the members, expiring February 1 of each odd-numbered year. 

 

SECTION 2.  (a) Provides that two of the five positions on THC with terms scheduled to expire on February 1, 2015, are abolished on that date.

 

(b) Provides that two of the six positions on THC with terms scheduled to expire on February 1, 2017, are abolished on that date.

 

(c) Provides that four of the six positions on THC with terms that, immediately before the effective date of this Act, are scheduled to expire on February 1, 2019, are abolished on September 1, 2013.

 

(d) Requires the governor, in appointing members to THC for terms scheduled to begin February 1, 2015, to appoint one member to THC for a term expiring February 1, 2019, and two members to THC for terms expiring February 1, 2021.

 

(e) Requires the governor, in appointing members to THC for terms scheduled to begin February 1, 2017, to appoint one member to THC for a term expiring February 1, 2021, and three members to THC for terms expiring February 1, 2023.

 

(f) Requires the governor, as soon as practicable after the effective date of this Act, to designate which members' positions shall be abolished as provided by this section and to inform the presiding officer of THC which positions are abolished.

 

SECTION 3.  Effective date: upon passage or September 1, 2013.
