Committee Report (Substituted)

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

Speech-language pathologists are regulated by the State Board of Examiners for Speech-Language Pathology and Audiology (board).  The board was reviewed by the Texas Sunset Advisory Commission in 2010 and was continued in existence by the Legislature in 2011 (S.B. 662) until September 1, 2017.  However, the Sunset Bill (S.B. 662) enacted in 2011, did not include several “clean-up” revisions to the laws regulating speech-language pathologists and audiologists because these revisions were not considered during the Sunset review process.

C.S.S.B. 312 amends Chapter 401 (Speech-Language Pathologists and Audiologists), Occupations Code, to provide numerous revisions relating to the regulation of speech-language pathologists and audiologists.

C.S.S.B. 312 amends current law relating to the regulation of speech-language pathology and audiology and the fitting and dispensing of hearing instruments.

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the State Board of Examiners for Speech-Language Pathology and Audiology (board) and the State Committee of Examiners in the Fitting and Dispensing of Hearing Instruments (committee) in SECTION 2 (Section 401.2022, Occupations Code), SECTION 7 (Section 402.1023, Occupations Code), and SECTION 12 of this bill.

Rulemaking authority is expressly granted to the board in SECTION 6 (Section 401.405, Occupations Code), SECTION 10, and SECTION 12 of this bill.

Rulemaking authority is expressly granted to the committee in SECTION 8 (Section 402.354, Occupations Code), and SECTION 12 of this bill.

Rulemaking authority previously granted to the board is rescinded in SECTION 9 (Section 401.309, Occupations Code) of this bill.
