AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S. B. 380 is a technical correction relating to H. B. 680, 82nd Legislature, 2011.  H. B. 680 made certain due process reforms relating to complaints filed with the Texas Medical Board (TMB).  One of these reforms granted a physician under review by TMB the authority to request that TMB make a recording of the physician's informal settlement conference proceeding at the physician's expense.  However, the bill did not include a provision whereby TMB was required to release the recording to the physician.

 

S. B. 380 amends the Occupations Code to require TMB, on request of the physician, to release the recording of the physician's informal settlement conference to the physician.

 

As proposed, S.B. 380 amends current law relating to the recording of an informal settlement conference to resolve a complaint to the Texas Medical Board against a physician.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 164.003(i), Occupations Code, to require the Texas Medical Board (TMB), on request of a physician under review in an informal settlement conference proceeding who requests TMB to make a recording of the proceeding, to release the recording to the physician. 

 

SECTION 2.  Effective date: upon passage or September 1, 2013.
