AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, there is developed commercial property located within the State Highway 288 corridor, and within the corporate limits of the City of Pearland, in Brazoria County.  A management district over this property is proposed to administer and provide funding for economic development projects and services in the district. 

 

This bill creates Pearland Municipal Management District No. 2 (district) as a political subdivision of the State of Texas to accomplish the public infrastructure and economic development purposes of the district. The district will be a municipal management district similar to those operating pursuant to Chapter 375 (Municipal Management Districts in General), Local Government Code, and Title 4 (Development and Improvement), Special Districts Code.

 

As proposed, S.B. 863 amends current law relating to the creation of Pearland Municipal Management District No. 2, provides authority to issue bonds, and provides authority to impose assessments, fees, and taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3867, as follows:

 

CHAPTER 3867.  PEARLAND MUNICIPAL MANAGEMENT DISTRICT NO. 2

 

Sets forth standard language for the creation of the Pearland Municipal District No. 2 (district) in the city of Pearland.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, and approval of the district (Sections 3867.001-3867.008);

 

Size, composition, appointment, and terms of the board of directors, including the appointment of the initial voting directors (Sections 3867.051-3867.055);

 

Powers and duties of the district (Sections 3867.101-3867.112); and

 

General financial provisions and authority to impose a tax and to issue bonds and obligations for the district (Sections 3867.151-3867.207).

 

Prohibits the district from exercising the power of eminent domain.  

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2013.
