AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In recent efforts to obtain documents and records from the Cancer Prevention and Research Institute of Texas Foundation (foundation), legal challenges arose as to whether the foundation qualifies as an entity subject to the state's open records laws.

C.S.S.B. 895 requires that the records of the foundation, or any subsequent nonprofit organization that provides support to the Cancer Prevention and Research Institute of Texas, be subject to open records laws under Chapter 552 (Public Information), Government Code.

 

C.S.S.B. 895 amends current law relating to access to records of a nonprofit organization supporting the Cancer Prevention and Research Institute of Texas under the public information law.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 102.262, Health and Safety Code, by adding Subsection (c), as follows:

 

(c)  Requires that the records of a nonprofit organization established to provide support to the Cancer Prevention and Research Institute of Texas be made available to the public.  Provides that a record that is available under this subsection is public information subject to Chapter 552 (Public Information), Government Code.

 

SECTION 2.  Effective date: upon passage or September 1, 2013.
