AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

When the Texas State University System was expanded and the legislature changed the name of Southwest Texas State University to Texas State University--San Marcos, it was with the goal that other universities in the system would similarly change their names to reflect the new system.  However, the other universities are named for founding fathers of Texas such as Sam Houston, Sul Ross, and Mirabeau Lamar, and do not wish to change their names.  To complicate matters, Texas State University--San Marcos opened a campus in Round Rock.  S.B. 974 reflects these realities and changes the statutory reference to Texas State University--San Marcos to Texas State University with campuses in San Marcos and Round Rock.

 

S.B. 974 amends current law relating to the name of Texas State University--San Marcos.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends the heading to Subchapter C, Chapter 96, Education Code, to read as follows:

 

SUBCHAPTER C.  TEXAS STATE UNIVERSITY

 

SECTION 2.  Amends Section 96.41, Education Code, as follows:

 

Sec. 96.41.  New heading: TEXAS STATE UNIVERSITY.  Changes the name of Texas State University--San Marcos to Texas State University.  Provides that Texas State University is a coeducational institution of higher education with campuses located in the city of San Marcos and in the city of Round Rock.  Provides that the university is under the management and control of the Board of Regents, Texas State University System.

 

SECTION 3.  Amends Section 54.511(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University. 

 

SECTION 4.  Amends Section 54.5381(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 5.  Amends the heading to Section 54.5382, Education Code, to read as follows:

 

Sec. 54.5382. INTERCOLLEGIATE ATHLETICS FEE: TEXAS STATE UNIVERSITY. 

 

SECTION 6.  Amends Section 54.5382(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 7.  Amends Section 55.1724(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 8.  Amends Section 55.1734(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 9.  Amends Section 55.1754(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 10.  Amends Section 61.003(3), Education Code, to redefine "general academic teaching institution."

 

SECTION 11.  Amends Section 62.021(a), Education Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 12.  Amends Section 411.050, Government Code, to change the name of Texas State University--San Marcos to Texas State University.

 

SECTION 13.  (a) Changes the name of Texas State University--San Marcos to Texas State University.

 

(b) Provides that a reference in law to Texas State University--San Marcos means Texas State University.

 

(c) Provides that an appropriation for the use and benefit of Texas State University--San Marcos is available for the use and benefit of Texas State University.

 

(d) Requires the board of regents of the Texas State University System and Texas State University--San Marcos to ensure that the change of the name made by this Act is implemented with as little unnecessary cost as possible.  Requires Texas State University--San Marcos, to the maximum extent practicable, to use all stationery and other consumable supplies that are printed with the institution's former name and are in its possession on the effective date of this Act.

 

SECTION 14.  Effective date: September 1, 2013.
