BACKGROUND AND PURPOSE

 

Interested parties note that municipalities and counties are currently prohibited from adopting regulations regulating the transfer, private ownership, keeping, transportation, licensing, or registration of firearms, ammunition, or firearm supplies. The parties further note that municipalities are also prohibited from regulating the discharge of a firearm at a sport shooting range. S.B. 987 seeks to authorize the attorney general to obtain an injunction against any municipality or county that adopts such a regulation in violation of those prohibitions.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 987 amends the Local Government Code to authorize the attorney general to bring an action in the name of the state to obtain a temporary or permanent injunction against a municipality or a county that, in violation of statutory prohibitions against adopting such regulations, adopts a regulation relating to the transfer, private ownership, keeping, transportation, licensing, or registration of firearms, ammunition, or firearm supplies or the discharge of a firearm at a sport shooting range.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
