AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1157 allows for a transfer of land between the Texas Board of Criminal Justice and Sam Houston State University.  This is an agreed-to transfer between the two parties and will allow Sam Houston State University to construct new academic facilities.

 

The land subject to transfer is approximately 82 acres.  The parcel is bound by SH-75N, IH-45, the Prison Museum and the HEARTS Museum.

 

As proposed, S.B. 1157 amends current law relating to the conveyance of certain state property for use by Sam Houston State University.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  (a) Requires the Texas Board of Criminal Justice (TBCJ), not later than January 1, 2014, to convey to the Board of Regents of the Texas State University System for use by Sam Houston State University the real property described by Subsection (e) of this section.

 

(b) Requires TBCJ to convey the property by deed without warranty regarding covenants of title.

 

(c) Requires that the deed include a provision that:

 

(1) requires Sam Houston State University to use the property primarily for a governmental purpose; and

 

(2) indicates that title to the property will automatically revert to TBCJ if Sam Houston State University fails to use the property primarily for a governmental purpose.

 

(d) Requires TBCJ to retain custody of the deed after the deed is filed in the real property records of Walker County.

 

(e) Sets forth the real property and boundaries of the real property referred to in this section.

 

SECTION 2.  Effective date: upon passage or September 1, 2013.
