AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Chapter 68 (Ship Channel Security Districts), Water Code, was added by H.B. 3011, 80th Legislature, Regular Session, 2007, providing for the creation and administration of a ship channel security district in a county with a population of 3.3 million or more that has a ship channel in the county.   Section 68.051 (Applicable to Facilities), Water Code, provides a list of types of facilities to which Chapter 68 applies. 

 

S.B. 1225 contains proposed revisions to Section 68.051 intended to limit the application of Chapter 68, in accordance with its original intent, to certain types of facilities based upon the nature of the business’s enterprise, the extent of security threats posed to the facility, and the extent of the benefit to be received by the facility from the security projects and services provided or financed by the district. 

 

As proposed, S.B. 1225 amends current law relating to the facilities to which Chapter 68, Water Code, applies.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 68.051(b), Water Code, as follows:

 

(b) Provides that this chapter applies to certain types of entities and facilities in a ship channel security district created under this chapter, including a facility included in one or more of the following categories and codes of the 2007 North American Industry Classification System: petrochemical manufacturing, 3251, rather than petroleum manufacturing, 325110; all other chemical manufacturing, 325998, rather than all other chemical and other manufacturing, 311111-33999; and transportation, including rail, water, and road transportation and pipelines, 482111-482112, 483111-483114, 484110-484230, 486110-486990, 488210, 488390, and 488310.

 

SECTION 2. Effective date: upon passage or September 1, 2013.
