AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Correctional Management Institute of Texas (CMIT) serves to train criminal justice professionals.  CMIT's headquarters are located at Sam Houston State University (SHSU) under the direction of the president of SHSU.

 

S.B. 1313 proposes to statutorily establish CMIT at SHSU in the same manner as the Bill Blackwood Law Enforcement Management Institute of Texas (LEMIT) established under Section 96.64 (Bill Blackwood Law Enforcement Management Institute of Texas), Education Code.  CMIT was originally established under appropriation only and SHSU operated CMIT under implied authority from the LEMIT statute.  However, the comptroller of public accounts of the State of Texas established during a 2012 post-payment audit that SHSU cannot operate CMIT in the same manner as LEMIT without specific statutory authority.  The proposed statute is similar to the LEMIT statute. 

 

S.B. 1313 amends current law relating to the Correctional Management Institute of Texas at Sam Houston State University.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the president of Sam Houston State University in SECTION 1 (Section 96.945, Education Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter D, Chapter 96, Education Code, by adding Section 96.645, as follows:

 

Sec. 96.645.  CORRECTIONAL MANAGEMENT INSTITUTE OF TEXAS. (a)  Defines "institute" in this section.

 

(b)  Provides that the Correctional Management Institute of Texas (CMIT) is established for the training of criminal justice professionals.  Provides that the headquarters of CMIT are at Sam Houston State University (SHSU).  Provides that CMIT is under the supervision and direction of the president of SHSU (president).

 

(c)  Authorizes the president to establish rules relating to CMIT.

 

(d)  Requires the president to establish reasonable charges for participation in CMIT training programs by participants who are not residents of this state.  Requires that the participation costs of participants who are residents of this state, including tuition, books, room, board, and travel costs, be paid from CMIT and the Criminal Justice Center Account in the general revenue fund.

 

(e)  Authorizes CMIT to provide fee-based training and professional development programming using funds other than appropriated funds.

 

SECTION 2.  Effective date: upon passage or September 1, 2013.
