AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1021, 78th Legislature, Regular Session, 2003, converted rural fire prevention districts to emergency services districts.  The emergency service districts assumed all obligations and outstanding indebtedness of the rural fire prevention district. 

 

S.B. 1425 adds language to Section 775.031 (District Powers) of the Health and Safety Code to clarify that a district that was formerly a rural fire prevention district that is not otherwise prohibited from providing fire prevention or fire-fighting services may provide those services.

 

As proposed, S.B. 1425 amends current law relating to the provision of fire prevention or fire-fighting services by certain emergency services districts.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 775.031, Health and Safety Code, by adding Subsection (b-1) to authorize a district that was formerly a rural fire prevention district that is not otherwise prohibited from providing fire prevention or fire-fighting services to provide those services. 

 

SECTION 2.  Effective date: September 1, 2013.
