AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, there is undeveloped property within the corporate limits and extraterritorial jurisdiction of the Town of Little Elm in Denton County that is proposed to be developed for residential and commercial purposes. A management district over this property is proposed to be created to administer and provide funding for public infrastructure, such as water, sewer, drainage, and road facilities, as well as other economic development projects and services in the district.

 

S.B. 1878 creates Highway 380 Municipal Management District No. 1 (district) as a political subdivision of the State of Texas to accomplish the purposes of the district. Under S.B. 1878, the district will be an improvement district similar to those operating pursuant to Chapter 375 (Municipal Management Districts in General), Local Government Code, and Title 4 (Development and Improvement), Special District Local Laws Code. 

 

S.B. 1878 amends current law relating to the creation of Highway 380 Municipal Management District No. 1, provides the authority to issue bonds, provides the authority to impose assessments, fees, or taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3920, as follows:

 

CHAPTER 3920.  HIGHWAY 380 MUNICIPAL MANAGEMENT DISTRICT NO. 1

 

Sets forth standard language for the creation of the Highway 380 Municipal Management District No. 1 (district) in Denton County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, and approval of the district (Sections 3920.001-3920.008);

 

Size, composition, election, and terms of the board of directors, including the appointment of initial directors (Sections 3920.051-3920.056);

 

Powers and duties of the district (Sections 3920.101-3920.111); and

 

General financial provisions and authority to impose a tax and to issue bonds and obligations for the district (Sections 3920.151-3920.206).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2013.
