AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1884 creates the Westwood Management District (district), an approximately 416-acre municipal management district located within the corporate limits of the City of League City.

 

Texas law provides for the creation of municipal management districts to promote, develop, encourage, and maintain employment, commerce, economic development, and the public welfare in the commercial areas of municipalities and metropolitan areas of this state.

 

It is necessary to create a district under Chapter 375 (Municipal Management Districts in General), Texas Local Government Code, and Section 59 (Conservation and Development of Natural Resources and Parks and Recreational Facilities; Conservation and Reclamation Districts), Article 16, Texas Constitution, in order to construct public infrastructure (water, sewer, drainage, and roads) to serve the land that is currently undeveloped. 

           

S.B. 1884 provides for the creation of a municipal management district within the corporate limits of League City that will include residential land. 

 

S.B. 1884 amends current law relating to the creation of the Westwood Management District, provides the authority to issue bonds, and provides the authority to impose fees or taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3917, as follows:

 

CHAPTER 3917.  WESTWOOD MANAGEMENT DISTRICT

 

Sets forth standard language for the creation of the Westwood Management District (district) in the city of League City.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation, purpose, and approval of the district (Sections 3917.001-3917.009);

 

Size, composition, appointment, and terms of the board of directors, including the appointment of the initial voting directors (Sections 3917.051-3917.055);

 

Powers and duties of the district (Sections 3917.101-3917.110);

 

General financial provisions and authority to impose a tax and to issue bonds and obligations for the district (Sections 3917.151-3917.207); and

 

Dissolution of the district (Section 3917.251).

 

Prohibits the district from exercising the power of eminent domain. 

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2013.
