BACKGROUND AND PURPOSE

 

Certain land in Fort Bend County is proposed to be developed as a master planned and mixed use development. Interested parties contend that the area would benefit from the creation of a municipal management district to provide utility and recreational facilities and services and roads. S.B. 1906 seeks to address this issue.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 1906 amends the Special District Local Laws Code to create the Fort Bend County Municipal Management District No. 1 to provide, subject to certain requirements, certain improvements, projects, and services for public use and benefit. The district's powers and duties include, subject to certain requirements, the authorization to issue obligations and impose assessments and property, operation and maintenance, and contract taxes. The bill grants the district a limited power of eminent domain, but, if the bill does not receive a vote of two-thirds of all the members elected to each house, the bill prohibits the district from exercising the power of eminent domain.

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
