A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to restrictions on the use of commercial social networking |
|
sites by sex offenders; imposing a criminal penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 62, Code of Criminal Procedure, is |
|
amended by adding Article 62.0552 to read as follows: |
|
Art. 62.0552. USE OF COMMERCIAL SOCIAL NETWORKING SITES BY |
|
CERTAIN OFFENDERS. (a) In this article, "commercial social |
|
networking site" has the meaning assigned by Article 62.0061(f). |
|
(b) A person required to register under this chapter who |
|
uses a commercial social networking site and is not otherwise |
|
prohibited from accessing the site under Section 13G, Article |
|
42.12, shall include the following information in the person's |
|
profile for the site and shall ensure the information is viewable by |
|
all visitors of the site: |
|
(1) an indication that the person is a sex offender; |
|
(2) the type of offense for which the person is subject |
|
to registration under this chapter and the city and county in which |
|
the person was convicted of or placed on deferred adjudication for |
|
that offense; |
|
(3) the person's full name, date of birth, sex, race, |
|
height, weight, eye color, and hair color; and |
|
(4) the address at which the person resides or intends |
|
to reside or, if the person does not reside or intend to reside at a |
|
physical address, a detailed description of each geographical |
|
location at which the person resides or intends to reside. |
|
SECTION 2. The change in law made by this Act in amending |
|
Chapter 62, Code of Criminal Procedure, applies to any person who, |
|
on or after the effective date of this Act, is subject to |
|
registration under that chapter, regardless of whether the offense |
|
for which the person is subject to registration was committed |
|
before, on, or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2013. |
