A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to mandatory supervision for certain inmates sentenced |
|
following violation of a condition of community supervision. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter E, Chapter 508, Government Code, is |
|
amended by adding Section 508.1491 to read as follows: |
|
Sec. 508.1491. MANDATORY SUPERVISION FOR CERTAIN INMATES |
|
SENTENCED FOLLOWING VIOLATION OF CONDITION OF COMMUNITY |
|
SUPERVISION. Sections 508.149(b), (c), and (d) do not apply to an |
|
inmate serving a sentence imposed following a violation of a |
|
condition of community supervision resulting in an adjudication of |
|
guilt on the original charge, unless: |
|
(1) the violation constituted the commission of an |
|
offense other than an offense involving the operation of a motor |
|
vehicle punishable by fine only; or |
|
(2) the original charge for which the inmate is |
|
serving a sentence is based on the commission of an offense for |
|
which registration as a sex offender is required under Chapter 62, |
|
Code of Criminal Procedure. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2013. |
