A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to entry of a guilty plea by a minor for certain offenses |
|
|
under the Alcoholic Beverage Code. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 106.10, Alcoholic Beverage Code, is |
|
|
amended to read as follows: |
|
|
Sec. 106.10. PLEA OF GUILTY BY MINOR. (a) Except as |
|
|
provided by this section, a [No] minor may not plead guilty to an |
|
|
offense under this chapter except in open court before a judge. |
|
|
(b) For an offense other than an offense under Section |
|
|
106.041, Subsection (a) does not apply to a minor who: |
|
|
(1) at the time the plea is entered, resides outside |
|
|
the county where the offense is alleged to have occurred; and |
|
|
(2) has not previously been convicted of an offense |
|
|
under this chapter. |

|
SECTION 2. This Act takes effect September 1, 2013. |
