A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the release of a vehicle held by a vehicle storage |
|
|
facility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2308.458, Occupations Code, is amended |
|
|
by adding Subsection (f) to read as follows: |
|
|
(f) The court may issue an order of release directing a |
|
|
vehicle storage facility to immediately release the vehicle to the |
|
|
owner of the vehicle or a booting company to immediately remove a |
|
|
boot from the vehicle. If the court finds that the person to whom an |
|
|
order described by this subsection was issued has not complied with |
|
|
the order, the court may issue an order directing the person to |
|
|
appear on a designated date and show cause why the person should not |
|
|
be held in contempt of court. If the court then finds that the |
|
|
person directly or indirectly disobeyed the order of release, the |
|
|
court may find the person in contempt of court and impose a |
|
|
punishment under Section 21.002(c), Government Code. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
