A BILL TO BE ENTITLED
 
AN ACT
  relating to the board of pilot commissioners for the ports of
  Galveston County.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 67.011, Transportation Code, is amended
  to read as follows:
         Sec. 67.011.  BOARD. The board of pilot commissioners for
  the ports of Galveston County is composed of:
               (1)  four [five] commissioners from Galveston County
  appointed by the governor with the advice and consent of the senate;
  and
               (2)  the chair of the Board of Trustees of the Galveston
  Wharves, or a member of the Board of Trustees of the Galveston
  Wharves designated by the chair.
         SECTION 2.  Section 67.012, Transportation Code, is amended
  to read as follows:
         Sec. 67.012.  PROHIBITED INTEREST. (a)  A person may not be
  a member of the board if the person has a conflict of interest that
  affects [or a direct or indirect interest in any business affected
  by or connected with] the performance of the person's duties as a
  pilot commissioner.
         (b)  Serving on both the Board of Trustees of the Galveston
  Wharves and the board of pilot commissioners for the ports of
  Galveston County is not a conflict of interest under this section.
         SECTION 3.  Section 67.014, Transportation Code, is amended
  by amending Subsection (a) and adding Subsection (c) to read as
  follows:
         (a)  Board members appointed by the governor serve staggered
  four-year terms of office.
         (c)  A board member described by Section 67.011(2) serves a
  term of office that coincides with the member's term on the Board of
  Trustees of the Galveston Wharves.
         SECTION 4.  (a)  The changes in law made by this Act in the
  qualifications of members of the board of pilot commissioners for
  the ports of Galveston County do not affect the entitlement of a
  member serving on the board immediately before the effective date
  of this Act to continue to carry out the board's functions for the
  remainder of the member's term.
         (b)  The term of a member of the board of pilot commissioners
  for the ports of Galveston County described by Section 67.011(2),
  Transportation Code, as added by this Act, begins on the date the
  first vacancy occurs after the effective date of this Act.
         SECTION 5.  This Act takes effect September 1, 2013.
