A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the board of pilot commissioners for the ports of |
|
|
Galveston County. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 67.011, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 67.011. BOARD. The board of pilot commissioners for |
|
|
the ports of Galveston County is composed of: |
|
|
(1) four [five] commissioners from Galveston County |
|
|
appointed by the governor with the advice and consent of the senate; |
|
|
and |
|
|
(2) the chair of the Board of Trustees of the Galveston |
|
|
Wharves, or a member of the Board of Trustees of the Galveston |
|
|
Wharves designated by the chair. |
|
|
SECTION 2. Section 67.012, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 67.012. PROHIBITED INTEREST. (a) A person may not be |
|
|
a member of the board if the person has a conflict of interest that |
|
|
affects [or a direct or indirect interest in any business affected
|
|
|
by or connected with] the performance of the person's duties as a |
|
|
pilot commissioner. |
|
|
(b) Serving on both the Board of Trustees of the Galveston |
|
|
Wharves and the board of pilot commissioners for the ports of |
|
|
Galveston County is not a conflict of interest under this section. |
|
|
SECTION 3. Section 67.014, Transportation Code, is amended |
|
|
by amending Subsection (a) and adding Subsection (c) to read as |
|
|
follows: |
|
|
(a) Board members appointed by the governor serve staggered |
|
|
four-year terms of office. |
|
|
(c) A board member described by Section 67.011(2) serves a |
|
|
term of office that coincides with the member's term on the Board of |
|
|
Trustees of the Galveston Wharves. |
|
|
SECTION 4. (a) The changes in law made by this Act in the |
|
|
qualifications of members of the board of pilot commissioners for |
|
|
the ports of Galveston County do not affect the entitlement of a |
|
|
member serving on the board immediately before the effective date |
|
|
of this Act to continue to carry out the board's functions for the |
|
|
remainder of the member's term. |
|
|
(b) The term of a member of the board of pilot commissioners |
|
|
for the ports of Galveston County described by Section 67.011(2), |
|
|
Transportation Code, as added by this Act, begins on the date the |
|
|
first vacancy occurs after the effective date of this Act. |
|
|
SECTION 5. This Act takes effect September 1, 2013. |
