A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to certain requirements before completing mold |
|
remediation work. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Section 1958.152, Occupations |
|
Code, is amended to read as follows: |
|
Sec. 1958.152. REMEDIATION WORK PLAN AND AGREEMENT; |
|
CONSUMER INFORMATION. |
|
SECTION 2. Section 1958.152, Occupations Code, is amended |
|
by amending Subsection (a) and adding Subsections (a-1) and (c) to |
|
read as follows: |
|
(a) A license holder who intends to perform mold remediation |
|
shall prepare a work plan providing instructions for the |
|
remediation efforts to be performed for the mold remediation |
|
project. |
|
(a-1) Before the mold remediation begins, the [The] license |
|
holder must: |
|
(1) [shall] provide the work plan and a mold |
|
information sheet to the client; and |
|
(2) obtain a signed agreement with the property owner |
|
concerning the terms and scope of the mold remediation project |
|
[before the mold remediation begins]. |
|
(c) The department shall prescribe the form and content of |
|
the mold information sheet described by Subsection (a-1)(1). |
|
SECTION 3. The change in law made by this Act to Section |
|
1958.152, Occupations Code, applies only to a mold remediation |
|
project commenced on or after the effective date of this Act. A mold |
|
remediation project commenced before the effective date of this Act |
|
is governed by the law in effect when the project commenced, and the |
|
former law is continued in effect for that purpose. |
|
SECTION 4. The executive commissioner of the Health and |
|
Human Services Commission shall adopt rules to implement Section |
|
1958.152(c), Occupations Code, as added by this Act, not later than |
|
December 1, 2013. |
|
SECTION 5. This Act takes effect September 1, 2013. |
