A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to excepting certain vehicle location information from |
|
|
required disclosure under the public information law. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 552.108, Government Code, is amended by |
|
|
adding Subsection (b-1) to read as follows: |
|
|
(b-1) Information held by a law enforcement agency or |
|
|
prosecutor that relates to the location of a vehicle used for law |
|
|
enforcement is excepted from the requirements of Section 552.021 |
|
|
if: |
|
|
(1) the information would directly or indirectly |
|
|
reveal the physical location of or route used by a peace officer or |
|
|
vehicle operated by a peace officer; or |
|
|
(2) the law enforcement agency determines that the |
|
|
release of the information may create a hazard to a peace officer, |
|
|
the public, or another person. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
