A BILL TO BE ENTITLED
 
AN ACT
  relating to the application of the offenses of disrupting public
  school classes or transportation to persons younger than 12 years
  of age.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 37.124(d), Education Code, is amended to
  read as follows:
         (d)  It is an exception to the application of Subsection (a)
  that, at the time the person engaged in conduct prohibited under
  that subsection, the person was younger than 12 years of age [a
  student in the sixth grade or a lower grade level].
         SECTION 2.  Section 37.126(c), Education Code, is amended to
  read as follows:
         
         (c) It is an exception to the application of Subsection
  (a)(1) that, at the time the person engaged in conduct prohibited
  under that subdivision, the person was younger than 12 years of age 
  [a student in the sixth grade or a lower grade level].
         SECTION 3.  The changes in law made by this Act apply only to
  an offense committed on or after the effective date of this Act. An
  offense committed before the effective date of this Act is covered
  by the law in effect when the offense was committed, and the former
  law is continued in effect for that purpose. For purposes of this
  section, an offense was committed before the effective date of this
  Act if any element of the offense was committed before that date.
         SECTION 4.  This Act takes effect September 1, 2013.
