A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the application of the offenses of disrupting public |
|
school classes or transportation to persons younger than 12 years |
|
of age. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 37.124(d), Education Code, is amended to |
|
read as follows: |
|
(d) It is an exception to the application of Subsection (a) |
|
that, at the time the person engaged in conduct prohibited under |
|
that subsection, the person was younger than 12 years of age [a
|
|
student in the sixth grade or a lower grade level]. |
|
SECTION 2. Section 37.126(c), Education Code, is amended to |
|
read as follows: |
|
(c) It is an exception to the application of Subsection |
|
(a)(1) that, at the time the person engaged in conduct prohibited |
|
under that subdivision, the person was younger than 12 years of age |
|
[a student in the sixth grade or a lower grade level]. |
|
SECTION 3. The changes in law made by this Act apply only to |
|
an offense committed on or after the effective date of this Act. An |
|
offense committed before the effective date of this Act is covered |
|
by the law in effect when the offense was committed, and the former |
|
law is continued in effect for that purpose. For purposes of this |
|
section, an offense was committed before the effective date of this |
|
Act if any element of the offense was committed before that date. |
|
SECTION 4. This Act takes effect September 1, 2013. |
