A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to public insurance adjusters' unauthorized removal of |
|
|
vehicles from vehicle storage facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 4102, Insurance Code, is |
|
|
amended by adding Section 4102.164 to read as follows: |
|
|
Sec. 4102.164. UNAUTHORIZED VEHICLE REMOVAL PROHIBITED. A |
|
|
license holder may not, without the knowledge and written consent |
|
|
of the insured: |
|
|
(1) execute a document related to the removal or |
|
|
inspection of a motor vehicle at a vehicle storage facility |
|
|
licensed under Chapter 2303, Occupations Code; or |
|
|
(2) remove a motor vehicle at such a vehicle storage |
|
|
facility. |
|
|
SECTION 2. Section 4102.164, Insurance Code, as added by |
|
|
this Act, applies only to conduct that occurs on or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
