A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the establishment of the veterinarian-client-patient |
|
|
relationship. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 801.351, Occupations Code, is amended by |
|
|
adding Subsection (a-1) and amending Subsection (b) to read as |
|
|
follows: |
|
|
(a-1) For purposes of Subsection (a)(1), an animal shelter |
|
|
may be considered the caretaker of an animal regardless of whether |
|
|
the shelter owns the animal. |
|
|
(b) A veterinarian possesses sufficient knowledge of the |
|
|
animal for purposes of Subsection (a)(2) if the veterinarian has |
|
|
recently seen, or is personally acquainted with, the keeping and |
|
|
care of the animal by: |
|
|
(1) examining the animal; or |
|
|
(2) making medically appropriate and timely visits to |
|
|
the premises, including an animal shelter, where [on which] the |
|
|
animal is kept. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
