A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the eligibility of persons with disabilities to use |
|
|
certain public transportation services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 461.009, Transportation Code, is amended |
|
|
by adding Subsection (c) to read as follows: |
|
|
(c) At the request of an individual who resides in a |
|
|
provider's service area and is eligible to use the provider's |
|
|
services, the provider shall provide written certification that the |
|
|
individual is eligible to use the provider's services. Proof of |
|
|
certification made under this subsection entitles the individual to |
|
|
obtain services from any provider in the state for not more than 60 |
|
|
days during a 365-day period that begins with the individual's |
|
|
first use of a provider's service outside of the service area in |
|
|
which the individual resides. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2013. |
