A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the effect on a credit report of certain transactions by |
|
a person's spouse pending a divorce decree. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 20.05, Business & Commerce Code, is |
|
amended by adding Subsection (d) to read as follows: |
|
(d) Except as otherwise provided by federal law, a consumer |
|
reporting agency may not include in a consumer report information |
|
about a transaction of a consumer's spouse described by Section |
|
6.707(a), Family Code, if the consumer provides a copy of the court |
|
order making a finding that the transaction was in violation of that |
|
section. |
|
SECTION 2. The change in law made by this Act applies to the |
|
submission of a court order to a consumer reporting agency for the |
|
correction of a consumer report on or after the effective date of |
|
this Act, regardless of whether the disputed transaction occurred |
|
or the court order was rendered before, on, or after the effective |
|
date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2013. |
