A BILL TO BE ENTITLED

AN ACT

re |

lating to the continuation of the Texas Women's Health Program. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 32 of the Human Resources Code is amended |
|
|
as follows: |
|
|
Section 32.021 (b-1) The department shall immediately apply |
|
|
for federal funds in the form of a Section 1115 Medicaid Waiver if |
|
|
the department ceases operation of the program under Section |
|
|
39.45(d) of this Code. |
|
|
(b-2) It is the Legislature's intent that the application |
|
|
under Section 32.021(b-1) be identical to what was made under the |
|
|
former federal Medicaid Women's Health Program, which ceased |
|
|
operations December 31, 2012. |
|
|
SECTION 2. This Act takes immediate effect immediately if |
|
|
it receives a vote of two-thirds of all members elected to each |
|
|
house, as provided by Section 39, Article III, Texas Constitution. |
|
|
If this Act does not receive the vote necessary for immediate |
|
|
effect, this Act takes effect September 1, 2013. |
