A BILL TO BE ENTITLED
 
AN ACT
  relating to payment of a public school teacher pending appeal of
  discharge for cause.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter G, Chapter 21, Education Code, is
  amended by adding Section 21.3011 to read as follows:
         Sec. 21.3011.  PAY PENDING REVIEW OF DISCHARGE FOR CAUSE.
  (a) This section applies to a teacher:
               (1)  employed under a continuing contract and
  discharged for good cause as determined by the board of trustees of
  a school district and as defined by Section 21.156; or
               (2)  employed under a term contract and discharged for
  good cause as determined by the board of trustees as provided under
  Section 21.211.
         (b)  Notwithstanding any other provision, a teacher who
  under this subchapter appeals to the commissioner a decision of the
  board of trustees or board subcommittee made under Section 21.259
  regarding discharge for good cause described by Subsection (a) may
  not receive pay from the school district pending the outcome of the
  appeal or any judicial appeal of the commissioner's decision
  affirming the decision of the board of trustees or board
  subcommittee.
         SECTION 2.  Section 21.3011, Education Code, as added by
  this Act, applies only to a teacher who files a petition for review
  with the commissioner of education under Section 21.301, Education
  Code, on or after the effective date of this Act. A teacher who
  files a petition for review before the effective date of this Act is
  governed by the law in effect when the petition for review was
  filed, and the former law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2013.
