A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to payment of a public school teacher pending appeal of |
|
|
discharge for cause. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter G, Chapter 21, Education Code, is |
|
|
amended by adding Section 21.3011 to read as follows: |
|
|
Sec. 21.3011. PAY PENDING REVIEW OF DISCHARGE FOR CAUSE. |
|
|
(a) This section applies to a teacher: |
|
|
(1) employed under a continuing contract and |
|
|
discharged for good cause as determined by the board of trustees of |
|
|
a school district and as defined by Section 21.156; or |
|
|
(2) employed under a term contract and discharged for |
|
|
good cause as determined by the board of trustees as provided under |
|
|
Section 21.211. |
|
|
(b) Notwithstanding any other provision, a teacher who |
|
|
under this subchapter appeals to the commissioner a decision of the |
|
|
board of trustees or board subcommittee made under Section 21.259 |
|
|
regarding discharge for good cause described by Subsection (a) may |
|
|
not receive pay from the school district pending the outcome of the |
|
|
appeal or any judicial appeal of the commissioner's decision |
|
|
affirming the decision of the board of trustees or board |
|
|
subcommittee. |
|
|
SECTION 2. Section 21.3011, Education Code, as added by |
|
|
this Act, applies only to a teacher who files a petition for review |
|
|
with the commissioner of education under Section 21.301, Education |
|
|
Code, on or after the effective date of this Act. A teacher who |
|
|
files a petition for review before the effective date of this Act is |
|
|
governed by the law in effect when the petition for review was |
|
|
filed, and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
