A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the limitations period for bringing an action arising |
|
|
from certain insurance claims. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 542, Insurance Code, is |
|
|
amended by adding Section 542.062 to read as follows: |
|
|
Sec. 542.062. LIMITATIONS PERIOD. A person must bring an |
|
|
action under this subchapter not later than four years after the |
|
|
date of the denial of the claim or the act or omission giving rise to |
|
|
the cause of action under this subchapter. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a cause of action that accrues on or after the effective date of |
|
|
this Act. A cause of action that accrues before the effective date |
|
|
of this Act is governed by the law applicable to the cause of action |
|
|
immediately before the effective date of this Act, and that law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
