A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to permits to construct reservoirs for the storage of |
|
|
state water. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.124(f), Water Code, is amended to |
|
|
read as follows: |
|
|
(f) If the application is for a permit to construct a |
|
|
storage reservoir, the application must also contain: |
|
|
(1) a draft permit authorizing the construction of the |
|
|
reservoir; and |
|
|
(2) evidence that the applicant has mailed notice of |
|
|
the application to each member of the governing body of each county |
|
|
and municipality in which the reservoir, or any part of the |
|
|
reservoir, will be located. |
|
|
SECTION 2. Section 11.134, Water Code, is amended by adding |
|
|
Subsection (d) to read as follows: |
|
|
(d) The commission shall grant or deny an application for a |
|
|
permit to construct a storage reservoir not later than the 180th day |
|
|
after the date on which the commission receives the application. If |
|
|
the commission does not grant or deny the application on or before |
|
|
that date, the commission is considered to have granted the |
|
|
application and issued the draft permit included in the |
|
|
application. |
|
|
SECTION 3. The changes in law made by this Act apply only to |
|
|
an application for a permit to construct a storage reservoir filed |
|
|
with the Texas Commission on Environmental Quality on or after the |
|
|
effective date of this Act. An application filed before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date the application was filed, and the former law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 4. This Act takes effect September 1, 2013. |
