A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to interbasin transfers of state water. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.085, Water Code, is amended by |
|
|
amending Subsection (b) and adding Subsection (w) to read as |
|
|
follows: |
|
|
(b) The application must include: |
|
|
(1) the contract price of the water to be transferred; |
|
|
(2) a statement of each general category of proposed |
|
|
use of the water to be transferred and a detailed description of the |
|
|
proposed uses and users under each category; |
|
|
(3) the cost of diverting, conveying, distributing, |
|
|
and supplying the water to, and treating the water for, the proposed |
|
|
users; [and] |
|
|
(4) the projected effect on user rates and fees for |
|
|
each class of ratepayers; and |
|
|
(5) a draft water right or amendment to a permit, |
|
|
certified filing, or certificate of adjudication authorizing the |
|
|
transfer. |
|
|
(w) The commission shall grant or deny an application for an |
|
|
interbasin transfer not later than the 180th day after the date on |
|
|
which the commission receives the application. If the commission |
|
|
does not grant or deny the application on or before that date, the |
|
|
commission is considered to have granted the application and issued |
|
|
the draft water right or amendment included in the application. |
|
|
SECTION 2. The changes in law made by this Act apply only to |
|
|
an application for an interbasin transfer filed with the Texas |
|
|
Commission on Environmental Quality on or after the effective date |
|
|
of this Act. An application filed before the effective date of this |
|
|
Act is governed by the law in effect on the date the application was |
|
|
filed, and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2013. |
