A BILL TO BE ENTITLED
 
AN ACT
  relating to interbasin transfers of state water.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.085, Water Code, is amended by
  amending Subsection (b) and adding Subsection (w) to read as
  follows:
         (b)  The application must include:
               (1)  the contract price of the water to be transferred;
               (2)  a statement of each general category of proposed
  use of the water to be transferred and a detailed description of the
  proposed uses and users under each category;
               (3)  the cost of diverting, conveying, distributing,
  and supplying the water to, and treating the water for, the proposed
  users; [and]
               (4)  the projected effect on user rates and fees for
  each class of ratepayers; and
               (5)  a draft water right or amendment to a permit,
  certified filing, or certificate of adjudication authorizing the
  transfer.
         (w)  The commission shall grant or deny an application for an
  interbasin transfer not later than the 180th day after the date on
  which the commission receives the application. If the commission
  does not grant or deny the application on or before that date, the
  commission is considered to have granted the application and issued
  the draft water right or amendment included in the application.
         SECTION 2.  The changes in law made by this Act apply only to
  an application for an interbasin transfer filed with the Texas
  Commission on Environmental Quality on or after the effective date
  of this Act. An application filed before the effective date of this
  Act is governed by the law in effect on the date the application was
  filed, and the former law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2013.
